Terms & Conditions
The Work Product. After booking with M+R Photography you have entered into a contract with the Photographer in which you expect the service of taking photos of you, your family, your wedding, etc. As well as to receive in a reasonable amount of time "The Work Product", digital, high quality, edited images. This is the "The Work Product" and upon receiving them the contract between M+R Photography and yourself is complete. No re-edits or Raw Unedited Images will be available. You have received the Final Work Product.
Photographers Use of The Work Product
The Photographer has rights to use the Work Product in social media and the M+R Photography Official Website. Unless otherwise agreed upon.
Session Duration
The duration of the session shall be for a set amount of time as agreed upon by both parties. The time shall commence at the agreed-upon start time, regardless of the client's arrival time. An exception will be made in the event that the Photographer arrives late, in which case the session will be extended to account for the delay.
Deposit Payment & Refund
Deposit amount varies per shoot. The photographer has full rights to keep deposit if the other party does not show. Full refund will be available if reasons for a "no show" involves weather, proof of emergency, or other circumstances that are out of reasonable control for the client.
Liability Waiver and Indemnification
- Assumption of Risk The Client acknowledges that participation in the photography session involves certain inherent risks, including but not limited to slips, trips, falls, and other accidents. The Client voluntarily assumes all such risks.
- Release of Liability The Client agrees to release, indemnify, and hold harmless the Photographer(s) from any and all claims, demands, actions, or causes of action that may arise from or relate to any injury or damage sustained during the session.
Gallery Life
You will have access to your online gallery and have the ability to download your photos for a maximum of 3 Months. After that period your gallery will expire.
Smoke Exposure and Early Termination
The Photographer reserves the right to discontinue services and leave the event at any time if cigar, cigarette, or other smoke exposure is present in a manner that the Photographer reasonably believes poses a risk to their health or safety. In the event that the Photographer elects to terminate services due to such conditions, the Client agrees that the Photographer shall not be considered in breach of this Agreement. The Client shall remain responsible for payment for the number of hours the Photographer was present and actively providing services at the event, calculated at the hourly rate outlined in negotiations, but shall not be responsible for payment for any remaining hours originally contracted but not completed. The Client will receive all usable photographs captured by the Photographer during the time services were provided, delivered in accordance with the standard delivery terms of this Agreement.
